PRIVACY (Information pursuant to Article 13 of EU Regulation 679/2016)

Dear Customer,
This is to inform you that, pursuant to Article 13 of Reg. (EU) 679/2016, any personal data collected shall be processed by our Company for the purpose of managing the relationship, and the legal and contractual obligations arising therefrom.
Under said Regulation:
a)  Traforo del Monte Bianco - GEIE is the ‘Data Controller’;
b)  If you are a natural person (also a sole proprietor or professional), you are the 'Data Subject' and your data shall be processed as indicated below; You also have the rights illustrated below.
c)  If you are a legal person (company, institution, etc.), you are NOT a 'Data Subject', your data are NOT Personal Data and the relative processing is NOT subject to the regulations in question.
d)  In any case, your directors/representatives/employees/collaborators/officers - whose personal data may be incidentally provided or communicated, having contacts with the Controller on your behalf - are ‘Data Subjects' and their data shall be processed as indicated below; they shall also have the rights illustrated below. You are therefore required to communicate this information to said Data Subjects.

Purposes. Management of the contract and tax obligations. Possible legal protection (in court or out of court) of their rights and sharing for internal administrative purposes with the two concessionary companies associated with the Data Controller (Società Italiana per Azioni per il Traforo del Monte Bianco and Société de Gestion du Tunnel du Mont Blanc - SGTMB).
Legal basis. Execution of a contract or pre-contractual activities, fulfilment of legal obligations and legitimate interests of the Controller and third parties.
Retention period. For a period of time not exceeding the fulfilment of the contractual purposes and the retention obligations provided for by the relevant laws. In the event of a dispute, they shall be kept for the period necessary for the dispute (e.g., the duration of legal proceedings).
Recipients. Personal data shall be processed by the Data Controller and persons strictly authorised by it. Your data shall not be communicated outside the Data Controller’s facility except for possible external Processors, with whom a contract is stipulated pursuant to Article 28 GDPR, or shared with the two concessionary companies (Società Italiana per Azioni per il Traforo del Monte Bianco and Société de Gestion du Tunnel du Mont Blanc - SGTMB). Finally, data may be disclosed to Public Authorities, including Judicial Authorities. The data shall not be disseminated.
Nature of data conferral and consequences of refusal to confer the data. Communication of your data is mandatory: the failed (or insufficient) conferment could, however, make it impossible for the Data Controller to fulfil its obligations.
Right to lodge a complaint with the Supervisory Authority. You have the right to lodge a complaint with the Supervisory Authority (For Italy: Garante per la protezione dei dati personali www.garanteprivacy.it and for France: CNIL Commission Nationale de l'Informatique et des Libertés www.cnil.fr/fr).
 
Rights of Data Subjects. You may exercise your rights at any time to access personal data, correct or erase them, limit processing, opposition and portability, for the purposes and within the limits as set out in Articles 15 to 21 of European Regulation 679/2016 by sending an email request to the address [email protected]
